 Draft rules: Social media firms to reveal first originator of message, OTT to self-regulate, digital media to have grievance officer

Social Media Guidelines & Rules for OTTs and digital media: The government has announced new rules for intermediary platforms, and social media intermediaries as well as for digital media and over the top (OTT) content players.

The Ministry of Electronics and Information Technology (MeITY) has announced its draft Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, for social media platforms, OTT players & digital media Thursday, with significant recommendations including asking social media companies to give out the originator of a message or tweet as the case may be.


“We have not framed any new law. We have framed these rules under the existing IT Act,” MeITY minister Ravi Shankar Prasad during a press conference announcing these rules. “We are trusting the platforms to follow these regulations,” he said. “The focus of this guideline is on self-regulation.”

The Rules will come in effect from the date of their publication in the gazette, except for the additional due diligence for significant social media intermediaries, which shall come in effect three months after publication of these Rules.



The rules also made a distinction between a significant social media intermediary and a regular social media intermediary. The government is yet to define the user size to determine who will constitute a significant social media intermediary, though the minister indicated players with more than 50 lakh users will be considered.



Social media companies and redressal 

The government wants social media companies to have a mechanism to address complaints from users. It wants social media intermediaries to have the following:


Chief Compliance Officer who shall be responsible for ensuring compliance with the Act and Rules.

Nodal Contact Person for 24×7 coordination with law enforcement agencies.

Resident Grievance Officer who shall perform the functions mentioned under Grievance Redressal Mechanism.

All these officers have to be residents of India.

The government says it is empowering the users of social media and other intermediaries. It wants companies to have a chief compliance officer for significant social media companies as well. The rules call for social media companies to publish a monthly compliance report as well.


“If there are complaints against the dignity of users, particularly woman that exploits their private parts of individuals or nudity or in sexual acts, impersonation, etc, you will be required to remove that within 24 hours,” Prasad said.


Track originator of a message

The rules also call for tracking of the ‘first originator’ of a message and apply to a significant social media intermediary. It also wants the significant social media intermediary to have a physical contact address in India published on its website or mobile app or both. For players like WhatsApp, which are end-to-end encrypted, this could mean they will be forced to break encryption in India in order to comply.

The government says while it is not interested in the content of the message, they wish to know who started the ‘mischief’. It wants social media platforms to disclose the first originator of the mischievous tweet or message as the case may be. This will be required in matters related to security and sovereignty of India, public order, or with regard to rape or any other sexually explicit material.


The rules also say that “users who wish to verify their accounts voluntarily shall be provided an appropriate mechanism to verify their accounts and provided with demonstrable and visible mark of verification.”

OTT content platforms, digital media

The government has called for a grievance redressal system for OTT platforms and digital news media portals as well. The government is also asking OTT platforms and digital news media to self-regulate and wants a mechanism for addressing any grievances.


While films have a censor board, OTT platforms will require to self-classify their movies and content based on age. The content will have to be classified based on age appropriateness. The government wants the OTT players to classify films based on 13+, 16+ and those for adults and clarified it is not bringing any kind of censorship to these platforms.


There has to be a mechanism of parental lock and ensuring compliance with the same. Platforms like Netflix already have an option for a parental lock.


For publishers of news on digital media, they will be “required to observe Norms of Journalistic Conduct of the Press Council of India and the Programme Code under the Cable Television Networks Regulation Act thereby providing a level playing field between the offline (Print, TV) and digital media,” according to the government.


It also wants a three-level grievance redressal mechanism. This will include self-regulation by the publishers;

self-regulation by the self-regulating bodies of the publishers and oversight mechanism.


The government wants digital media to appoint a Grievance Redressal Officer based in India who shall be responsible for the redressal of grievances received by it. The officer shall take decision on every grievance received by it within 15 days.


There maybe one or more self-regulatory bodies of publishers. According to the rules, this body “shall be headed by a retired judge of the Supreme Court, a High Court or independent eminent person and have not more than six members.”


The body will have to register with the Ministry of Information and Broadcasting. This body will oversee the adherence by the publisher to the Code of Ethics and address grievances that have not be been resolved by the publisher within 15 days.


Further, the Ministry of Information and Broadcasting shall formulate an oversight mechanism. It shall publish a charter for self-regulating bodies, including Codes of Practices and establish an Inter-Departmental Committee for hearing grievances.

న్యూఢిల్లీ, ఫిబ్రవరి 25: సామాజిక మాధ్యమాలను కట్టడి చేసే కొత్త నిబంధనలను కేంద్ర ప్రభుత్వం రూపొందించింది. కొత్త నియమావళి ప్రకారం..  దేశ సమగ్రత, సార్వభౌమత్వానికి భంగం కలిగించే వ్యాఖ్యలను 24 గంటల్లో తొలగించడంతో పాటు.. వాటిని మొదటిగా చేసిన వ్యక్తి ఎవరో గుర్తించాల్సిన బాధ్యత సోషల్‌ మీడియా సంస్థలదే. అలాగే, నెట్‌ఫ్లిక్స్‌ వంటి ఓటీటీలను నియంత్రించే నిబంధనలను కూడా కేంద్రం రూపొందించింది. డిజిటల్‌ మీడియాలో పారదర్శకత, జవాబుదారీ తనం లోపించడం.. వినియోగదారుల హక్కులపై పెరుగుతున్న ఆందోళనల నేపథ్యంలో సంబంధిత వర్గాలన్నింటితో చర్చలు జరిపి ఈ నియమావళిని రూపొందించినట్టు కేంద్ర మంత్రులు రవిశంకర్‌ ప్రసాద్‌, ప్రకాశ్‌ జావడేకర్‌ తెలిపారు. ‘‘సోషల్‌ మీడియా సంస్థలు భారత దేశంలో వ్యాపారం చేయడాన్ని, లాభాలు ఆర్జించడాన్ని స్వాగతిస్తాం.




కానీ, ఆయా సంస్థలు రాజ్యాంగాన్ని, మన దేశ చట్టాలను గౌరవించాలి. సోషల్‌ మీడియా ప్లాట్‌ఫామ్‌లు.. సాధారణ వినియోగదారులకు తమ సృజనాత్మకతను ప్రదర్శించుకునే, ప్రశ్నించే, తమ అభిప్రాయాలను పంచుకునే, ప్రభుత్వాన్ని, ప్రభుత్వ వ్యవస్థలను విమర్శించే అవకాశాన్ని వారికిచ్చాయి. అయితే, ఈ క్రమంలో ఆయా ప్లాట్‌ఫామ్‌ల దుర్వినియోగాన్ని అడ్డుకోవాల్సిన బాధ్యత సోషల్‌ మీడియా సంస్థలదే. సోషల్‌ మీడియాను వాడుకునే సాధారణ వినియోగదారులకు ఈ కొత్త నిబంధనలు సాధికారతనిస్తాయి. వారి ఫిర్యాదులను పట్టించుకుని సకాలంలో పరిష్కరించే ఒక వ్యవస్థను రూపొందిస్తాయి.’’ అని పేర్కొన్నారు. ఇక.. ‘‘వదంతులను ప్రచారం చేసే హక్కు డిజిటల్‌ మీడియా వెబ్‌సైట్లకు లేదు. మీడియాకు సంపూర్ణ స్వేచ్ఛ ఉంటుంది. కానీ.. కొన్ని సహేతుకమైన పరిమితులతో’’ అని జావడేకర్‌ వ్యాఖ్యానించారు.




రెండు రకాలు..


కొత్త నియమావళి ప్రకారం కేంద్రం సామాజిక మాధ్యమాలను.. వాటి వినియోగదారుల సంఖ్య ఆధారంగా రెండు రకాలుగా విభజించింది.  తక్కువ వినియోగదారులున్న వాటిని సాధారణ సామాజిక మాధ్యమాలుగా, ఎక్కువ వినియోగదారులున్నవాటిని ప్రముఖ సామాజిక మాధ్యమాలుగా పరిగణిస్తామని పేర్కొంది. రెండు రకాల మాధ్యమాలూ నిబంధనలను పాటించాలి. ప్రముఖ సామాజిక మాధ్యమాలు అదనంగా మరిన్ని నిబంధనలను పాటించాల్సి ఉంటుంది. రెండు రకాల మాధ్యమాలూ పాటించాల్సిన నిబంధనలు..




అన్ని రకాల సామాజిక మాధ్యమాలూ తమతమ ప్లాట్‌ఫామ్‌లపై పోస్ట్‌ అయ్యే సమాచారం విషయంలో  జాగరూకతతో ఉండాలి. ఐటీ చట్టం ప్రకారం సామాజిక మాధ్యమాలకు కొన్ని ‘సేఫ్‌ హార్బర్‌ ప్రొవిజన్లు’ ఉంటాయి. అంటే.. ఆయా ప్లాట్‌ఫామ్‌లపై వినియోగదారులు చేసే పోస్టుల బాధ్యత సోషల్‌ మీడియా సంస్థలకు ఉండదు. ఇక నుంచి అలా కుదరదు. జాగ్రత్తగా ఉండకపోతే సేఫ్‌ హార్బర్‌ ప్రొవిజన్‌ వాటికి వర్తించదు.




వినియోగదారుల నుంచి వచ్చే ఫిర్యాదుల పరిష్కారానికి సోషల్‌ మీడియా సంస్థలు ఒక అధికారిని నియమించాలి. ఆ అధికారి పేరు, వివరాలు అందుబాటులో ఉంచాలి. ఫిర్యాదు అందిన 24 గంటల్లోగా అధికారి ఆ విషయాన్ని వారికి తెలియజేయాలి. 15 రోజుల్లోగా పరిష్కరించాలి. సోషల్‌ మీడియా వినియోగదారుల.. ముఖ్యంగా మహిళా యూజర్ల ఆన్‌లైన్‌ భద్రతను, గౌరవాన్ని కాపాడాలి. ఫిర్యాదులు వచ్చిన 24 గంటల్లోగా వారిని ఇబ్బంది పెట్టే కంటెంట్‌ను, వారి రహస్య అవయవాలను బహిర్గతం చేసే చిత్రాలు,  శృంగారంలో పాల్గొనే దృశ్యాలు, మార్ఫింగ్‌ చిత్రాలు ఉంటే తొలగించాలి. 




‘అదనపు’ జాగ్రత్తలు..


కేంద్రం విభజించిన ప్రకారం ‘ప్రముఖ సామాజిక మాధ్యమాల’కు మరికొన్ని అదనపు బాధ్యతలు ఇవి..


సోషల్‌ మీడియా సంస్థలు చట్టాలు, నిబంధనల ప్రకారం నడుచుకునేలా చూడడం కోసం ‘చీఫ్‌ కంప్లయన్స్‌ అధికారి’ని నియమించాలి.  పోలీసులు, సీబీఐ వంటి లా ఎన్‌ఫోర్స్‌మెంట్‌ ఏజెన్సీలకు 24 గంటలూ అందుబాటులో ఉండేలా ‘నోడల్‌ కాంటాక్ట్‌ పర్సన్‌’ను నియమించాలి. ఫిర్యాదుల పరిష్కారాల కోసం రెసిడెంట్‌ గ్రీవన్స్‌ అధికారిని నియమించాలి. వీరంతా భారత్‌లో నివసించేవారై ఉండాలి. అందుకున్న ఫిర్యాదులు, వాటిపై తీసుకున్న చర్యలతోపాటు.. ఫిర్యాదులు రాకముందే తొలగించిన కంటెంట్‌ తాలూకూ వివరాలతో ప్రతి నెలా సవివరమైన నివేదికను సామాజిక మాధ్యమాలు ప్రచురించాలి.




దేశ సమగ్రతకు, సార్వభౌమాధికారానికి, భద్రతకు సంబంధించిన.. విదేశాలతో సత్సంబంధాలను దెబ్బతీసే.. అత్యాచారం, చిన్నారులపై లైంగిక వేధింపులకు సంబంధించిన.. కంటెంట్‌ను ప్రభుత్వం లేదా కోర్టు ఆదేశించిన 24 గంటల్లో తొలగించాలి. వాటిని సామాజిక మాధ్యమాల్లో తొలిసారి పోస్ట్‌  చేసిన వ్యక్తి ఎవరో గుర్తించాలి. ఇది మెసేజింగ్‌ రూపంలో సేవలు అందించే ప్రముఖ సామాజిక మాధ్యమాలకు ముఖ్యం గా వర్తిస్తుంది (అంటే.. వాట్సాప్‌ వంటివాటికి. నిజానికి వాట్సాప్‌ సామాజిక మాధ్యమం కాదు. మెసేజింగ్‌ యాప్‌ మాత్రమే. కానీ, వాట్సాప్‌ ద్వారా దుష్ప్రచారం జరుగుతున్న నేపథ్యంలో ఈ నిబంధన పెట్టారు).




దర్యాప్తు సంస్థల నుంచి లిఖితపూర్వక అభ్యర్థన వస్తే.. వారు అడిగిన సమాచారాన్ని 72 గంటల్లోగా సమర్పించాలి. ఆ రికార్డులను దర్యాప్తు నిమిత్తం 180 రోజులు దాచి ఉంచాలి. ప్రముఖ సామాజిక సంస్థలు భారతదేశంలో తమ కార్యాలయం చిరునామాను వెబ్‌సైట్‌లో, యాప్‌లో తప్పనిసరిగా ఇవ్వాలి.




తమ ఖాతాలను ధ్రువీకరించడానికి సిద్ధమయ్యే వారికోసం ‘వాలంటరీ యూజర్‌ వెరిఫికేషన్‌ మెకానిజమ్‌’ను రూపొందించాలి. వినియోగదారులు చేసిన పోస్టును తొలగించే ముందు.. వారి వాదన చెప్పడానికి అవకాశం ఇవ్వాలి. అయినప్పటికీ ఆ సమాచారాన్ని తొలగించాలనుకుంటే ఆ విషయాన్ని వారికి ముందు గా తెలపాలి.  దేశ సమగ్రతకు, సార్వభౌమాధికారానికి భంగం కలిగించే.. విదేశాలతో సత్సంబంధాలను దెబ్బతీసే అంశాలకు సంబంధించిన కంటెంట్‌ను తొలగించాలంటూ కోర్టు ఆదేశించినప్పుడు.. ప్రభుత్వ వ్యవస్థలు కోరినప్పుడు అలాంటి నిషేధిత సమాచారాన్ని తొలగించాలి. సామాజిక మాధ్యమాలకు సంబంధించిన నిబంధనలు గెజెట్‌లో ప్రచురితమైనప్పటి నుంచి అమల్లోకి వస్తాయి. ప్రముఖ సామాజిక మాధ్యమాలు అదనంగా పాటించాల్సిన నిబంధనలు గెజెట్‌లో ప్రచురితమైన 3 నెలల తర్వాత అమల్లోకి వస్తాయి.




డిజిటల్‌ మీడియా నిబంధనలు..


డిజిటల్‌ మీడియా, ఓటీటీ ప్లాట్‌ఫామ్‌ల నియంత్రణకు రూపొందించిన ఎథిక్స్‌ కోడ్‌ ప్రకారం..


ఓటీటీ ప్లాట్‌ఫామ్‌లు తాము ప్రసారం చేసే కంటెంట్‌ను వయసు ఆధారంగా ఐదు కేటగిరీలుగా విభజించాలి. అవి.. అన్ని వయసులవారూ చూడదగ్గవి (యు), ఏడేళ్లు, అంతకుమించి వయసున్నవారు చూడగలిగే యూఏ 7+ చిత్రాలు, యూఏ 13+, యూఏ 16+, పెద్దలే చూడాల్సిన ఏ కేటగిరీ. ఇంట్లో పిల్లలు చూడకుండా చేసే పేరెంటల్‌ లాక్‌ను, వయసు ధ్రువీకరించుకునే విధానాలను అందుబాటులోకి తేవాలి. 




ఆన్‌లైన్‌ క్యూరేటెడ్‌ కంటెంట్‌ పబ్లిషర్లు (వివిధ సోర్సుల నుంచి సేకరించిన సమాచారానికి తమదైన వ్యాఖ్యానాన్ని జోడించి తమ యూట్యూబ్‌ చానల్‌ ద్వారానో, ఫేస్‌బుక్‌ ఖాతా ద్వారానో ఆన్‌లైన్‌లో పబ్లిష్‌ చేసేవారు) ఆ కంటెంట్‌ ఏ విభాగంలోకి వస్తుందో ముందే తెలపాలి. నిర్ణీత వయసులవారు మాత్రమే వాటిని చూడాలనే సూచన ముందుగానే చేయాలి. డిజిటల్‌ మీడియా పబ్లిషర్లు.. ప్రెస్‌ కౌన్సిల్‌ ఆఫ్‌ ఇండియా, కేబుల్‌ టెలివిజన్‌ నెట్‌వర్క్స్‌ రెగ్యులేషన్‌ యాక్ట్‌ నిబంధనలను పాటించాలి. ఫిర్యాదుల పరిష్కార వ్యవస్థను ఏర్పాటు చేసుకోవాలి.

న్యూఢిల్లీ, ఫిబ్రవరి 25: సోషల్‌ మీడియా, డిజిటల్‌ మీడియా, ఓటీటీ ప్లాట్‌ఫామ్‌ల కట్టడికి కేంద్ర ప్రభుత్వం రూపొందించిన కొత్త నియమావళిపై న్యాయనిపుణుల్లో భిన్నాభిప్రాయాలు వ్యక్తమవుతున్నాయి. కేంద్రం విధించిన పరిమితులు రాజ్యాంగంలోని 19వ  అధికరణానికి  లోబడి ఉంటే చెల్లుతాయని కొందరు న్యాయనిపుణులు పేర్కొన్నారు. ఏదేమైనా సోషల్‌ మీడియా సంస్థలు భారత చట్టాలకు అనుగుణంగా పనిచేయాల్సిందేనని.. వాటిని నియంత్రించే హక్కు ప్రభుత్వానికి ఉందని చెబుతున్నారు. మరికొందరేమో.. అసలు ఈ నిబంధనలు రాజ్యాంగం ప్రసాదించిన వాక్స్వాతంత్ర్యానికి, వ్యక్తిగత గోప్యతకు భంగమని తేల్చిచెబుతున్నారు.   సోషల్‌ మీడియా సంస్థలు భారత చట్టాలకు కట్టుబడి పనిచేయాల్సిందేనని కేంద్ర హోం మంత్రి అమిత్‌షా స్పష్టం చేశారు. కొత్త నిబంధనలు వినియోగదారులకు సాధికారతనిస్తాయని తెలిపారు. ఇక.. కొత్త నిబంధనలను పూర్తిగా అధ్యయనం చేయాల్సి ఉందని ఫేస్‌బుక్‌ సంస్థ పేర్కొంది. సోషల్‌ మీడియా, ఓటీటీ ప్లాట్‌ఫామ్‌ల కంటెంట్‌పై కేంద్రం రూపొందించిన కొత్త నియమావళిని స్వాగతిస్తున్నామని బీజేపీ నేత విజయశాంతి తెలిపారు.

REGULATION OF ONLINE CURATED CONTENT PLATFORMS IN INDIA Vineet    Editor's Column    May 9, 2020  |  0   By Shivali Shah and Sahastranshu, Editorial Board, RSRR.   What are Online Curated Content Platforms and how are they different from other platforms and mediums? Online Content Curated Platforms [OCCPs], are online platforms that curate a range of content and present it on a singular platform. Examples of these platforms include Netflix, Amazon Prime, Hotstar, AltBalaji amongst others. They are essentially video on demand (VOD) platforms whose primary function is to make video content available to the people. They are based on what is commonly referred to as a ‘pull’ model,[1] where consumers choose what they wish to watch at a time and place of their choosing. OCCPs are different from other online platforms like Youtube, Facebook, Instagram etc. which provide user generated content (UGC). It is important to distinguish OCCPs from other UGC platforms to understand the difference in applicability of laws. UGC platforms compared to OCCPs have limited control over the content that is being uploaded on their platforms. On UGC platforms, the majority of the content is uploaded by the users which is then subject to the guidelines and policies issued by the platforms, whereas in the case of OCCPs, the platforms themselves upload all the content.   Overview of Current Scenario Currently there are no specific laws pertaining to OCCPs. However, they are bound to follow other laws of the country pertaining to legality of content. Thus restrictions on content under provisions of the Information Technology Act[2], 2000, Indian Penal Code, 1860[3], Protection of Children from Sexual Offences Act, 2012[4], which deem content that is obscene, inciting violence, displaying child pornography or defamatory illegal, do apply. They are further subject to all the restrictions on freedom of speech and expression under Article 19(2) of the Indian Constitution. Therefore, any content that would be illegal offline, would also be considered to be illegal online. [5] Currently OCCPs in India have their own internal guidelines and policies for content moderation and internal complaint redressal mechanisms. In May 2019, the Supreme Court of India issued a notice to the Centre following a plea filed by the Justice for Rights Foundation[6], calling for the regulation of content being made available on such OCCPs. Further, in March 2020, the Ministry of Information and Broadcasting is reported to have given the stakeholders of the OCC industry 100 days to finalise a uniform code of conduct and set up an adjudicatory body for the same. [7] While the ministry has clarified it won’t censor any content, it has insisted on age certification and better complaint redressal. [8] This move came shortly after the Internet and Mobile Association of India [IAMAI]  in February 2020, proposed a second uniform code of conduct,[9] providing for an independent adjudicating body , the Digital Content Complain Council [DCCC]. Only 4 platforms have currently agreed to sign the same yet. The IAMAI, earlier in 2019, came out with a similar Code of Best Practices for Online Curated Content Providers. This code had 8 signatories and did not provide for an independent adjudicatory body. [10]   What would a uniform self regulation code entail? Given the likely scenario of a self regulation code, it is vital to understand what this code would practically imply. The self regulation code for the OCCPs, proposed by the IAMAI, in 2020 contains a description of what kind of content will be prohibited, and requires the platforms to classify content, provide maturity rating and allow parental or access controls.[11] These guidelines would be in addition to the statutory restrictions under various laws mentioned earlier. In its current form, these guidelines are applicable only to the platforms that choose to sign this code. The purpose of this code is essentially to enable the OCCPs to exercise caution with regard to the content that they put up on their platforms and further provide more information to the viewers regarding the content available, to make a more informed choice. Currently, the non news and current affairs television channels’ model of self regulation can also be taken as an example of a self regulation model. This code of conduct is applicable to all non news channels on television, as opposed to only those who sign it. It provides for a two tier redressal mechanism with an independent adjudicating body called the Broadcasting Content Complaints Council and further, restrictions on the content that can be broadcasted, with content categorisation guidelines.[12] As mentioned earlier, the IAMAI has in the past year and a half, come out with two sets of self regulatory codes, the primary difference being, the latter, provides for an independent adjudicating body the  DCCC, which was absent in the former. The proposal of this body is what is considered to be primary bone of contention between the non signatories and the IAMAI. Most industry players are of the view that an adjudicatory body could open the doors to possible censorship in the future, and while some of them approved of the earlier code, were not willing to sign the second one that provides for this body. The question thus arises over the need of an adjudicating body in addition to a self regulatory code. If any code of conduct for the OCCPs is to be applied, it must be accompanied by some form of enforcement mechanism. The primary motive behind an adjudicating body is to provide for accountability and ensure compliance with the provisions of the code. An adjudicating body provides an additional layer or accountability and enforceability to the internal redressal mechanisms that most platforms have. In case of the second code  of the IAMAI, the primary function of the proposed DCCC is to oversee the adherence of OCCPs to the self regulatory code and act as the second tier of grievance redressal. Pursuant to receiving a complaint, the DCCC may direct any platform, to reclassify ratings, include a warning, edit the synopsis of any form of content and/or even impose a penalty on the platforms. Modification or withdrawal of any content has not been provided for in the code. The decisions of the DCCC are binding only on signatories but no penalties are mentioned in case of non compliance. There is a clear lack of enforceability of the decisions of the DCCC rendering the purpose of the DCCC redundant. Looking at the BCCC model, in case of repeated non compliance with the decisions and warnings of Council, the I&B Ministry is notified and encouraged to take appropriate action. The I&B Ministry has reportedly stated that the new code must create an adjudicatory body.[13] The new rules that the OCC industry formulates may be based upon IAMAI’s model or it may draw inspiration from the non news and current affairs television channels’ self regulation code, or it may even take an entirely different approach. At this point, it is purely conjecture.   Challenges VOD services that are provided by these OCCPs are not akin to services provided by Cable TV or Cinema Halls. OCCPs are unique in the sense that currently there are no specific regulatory laws applicable to them and the same has been confirmed by the Ministry of Information and Broadcasting[14]. Even though the Information Technology Act 2000 does apply to them, they do not fall under the definition of ‘Intermediary’ going by the literal interpretation. An ‘intermediary’ has been defined in Section 2(w) of the Act as “any person who on behalf of another person receives, stores or transmits that record or provides any service with respect to that record and includes telecom service providers, web-housing service providers, search engines, online payment sites, online auction sites, online marketplaces and cyber cafes.” These OCCP’s apart from hosting third party content also produce original content for which they are not an ‘intermediary’. With respect to the content for which they are not an ‘intermediary’, they can only be punished for publication of sexually explicit, obscene or any material depicting children in a sexual manner. For example, Section 69A of the IT Act that provides for blocking public access to any information through any computer resource in the interest of the sovereignty & integrity of India, public order, friendly relations with foreign states or any other reason if necessary, is not applicable to these OCCPs, as they are not intermediaries. Even if the OCCPs do come up with a code, the problems with their regulation are manifold. At the outset itself, the fact that there are numerous such OCCPs apart from the major ones such as Netflix, Amazon, Hotstar, AltBalaji, Zee5, SonyLIV to name a few, it is a far fetched idea that each and every one of these OCCP’s would be inclined to sign the code.  Earlier this year, the IAMAI came up with a new set of code but major players such as Netflix, AltBlalaji, Zee5, refused to be bound by it and asked for its recall[15]. This code by IAMAI provides for the creation of a Digital Content Complaint Forum(at the OCCP level) and DCCC (adjudicatory body). Even though they have managed to come up with a code, there is a complete absence of an enforcement mechanism. The code in terms of imposing measures on the defaulting OCCP talks about, reclassifying of ratings, issuing warning cards and levying a financial penalty up to Rs. 3 lakhs[16]. It is apparent that this code is without any actual teeth. Similarly, even if another code is formulated, signed and brought into force with more stringent penalizing measures there still won’t be any enforcement mechanism. Say, for example, what would stop an OCCP to make available any content in violation of the said code, and how would the adjudicatory body actually force the OCCP to remove such content until and unless it is directly in violation of any other statutory law. The idea of self-regulation is only being pushed forward both by the government and the OCCPs because any other mode of exercising control is far more impractical, be it certification, or a statute specifically for OCCPs like the Cable Act. For instance, if certification is made a must for OCCPs, it would mean that a certificate would be required by the OCCP to release a movie on its platform, while the same movie might be available on YouTube later without any certification.[17]   Conclusion The recent developments including the release of the new code by the IAMAI and post that, a directive from the ministry asking the OCCPs themselves to draft a code of regulation have generated arguments both in favour and against regulation of this sector. Some argue that with the existence of statutory provisions governing the legality of content being put up as mentioned above, there is no need for additional regulations governing the industry. Accordingly, additional restrictions on the content being displayed would amount to censorship, as has been seen in traditional cinema and a curtailing of artistic freedom and thought. However, it is important to note that as of now, although the general laws do apply to them and provide for restrictions like complete ban on child pornography, they are almost non existent when compared to those exercised on television or theatre broadcasts. Further, the government has emphasized its reluctance to censor and encouraged responsible viewing by demanding appropriate rating and warnings. Notwithstanding the feasibility factor of self regulation of OCCPs, it is more propitious that we leave the OCC industry be. While that may seem like the devil-may-care way of letting an unregulated industry go rampant, it is important that we remember that the people running these OCCPs are still subject to the laws of the land. Naturally a person should not be deprived of enjoying a particular content just because it is deemed offensive by someone else. What is explicit, communal or obscene cannot be measured on a scale or ascertained by a standard formula. The classification, if any, should be limited to what is legal to watch and what isn’t. Considering that, it would be most opportune to widen the scope of the Information Technology Act and include these OCCPs within the definition of ‘intermediary’. This would mean that any censorship, if it takes place, would be done by the authority of law, and because the content being censored is in violation of the act itself, hence illegal. This action would also help to bring what is communal, obscene or otherwise inappropriate under an existing legal framework and thus would be decided under a semi-standard formula that is continuously evolving itself in line with the changing times.

 బీజేపీ నాయకుల విద్వేషపూరిత ప్రసంగాలను ఫేస్‌బుక్‌ చూసీచూడనట్లుగా వదిలేస్తోందంటూ ఇటీవల వాల్‌స్ట్రీట్‌ జర్నల్‌లో ఒక కథనం వెలువడింది. మత విద్వేష వ్యాఖ్యలు చేసినట్లు ఆరోపణలున్న తెలంగాణకు చెందిన ఒక బీజేపీ ఎమ్మెల్యేపై శాశ్వత నిషేధం విధించాలని తీసుకున్న నిర్ణయం భారత్‌లోని తమ ఉన్నతాధికారి జోక్యం కారణంగా ఆగిపోయిందని ఫేస్‌బుక్‌ ఉద్యోగులు కొందరు తెలిపారంటూ ఆ కథనంలో పేర్కొంది.


దీనిపై కాంగ్రెస్‌ నేత రాహుల్‌ గాంధీ ఆదివారం స్పందించారు. ‘బీజేపీ, ఆర్‌ఎస్‌ఎస్‌ భారత్‌లో ఫేస్‌బుక్, వాట్సాప్‌లను నియంత్రిస్తున్నాయి. వీటి ద్వారా తప్పుడు వార్తలను, విద్వేషాన్ని వ్యాప్తి చేస్తున్నాయి. ఓటర్లను ప్రభావితం చేయాలని చూస్తున్నాయి’అని ఆరోపించారు. ఈ వ్యవహారంపై సంయుక్త పార్లమెంటరీ కమిటీతో విచారణ జరిపించాలని డిమాండ్‌ చేశారు. ఆ పార్టీ ప్రతినిధి సుప్రియా శ్రీనాతే సోమవారం మీడియాతో మాట్లాడుతూ..ప్రపంచంలో ప్రజాస్వామ్యం అభివృద్ధి చెందుతున్న దేశాల్లో ఒకటైన భారత్‌లో.. విద్వేషాన్ని ప్రేరేపించే వ్యక్తులు లేదా వేదికలను వదలకూడదు. ఫేస్‌బుక్‌ నిష్క్రియాపరత్వం ఫలితంగా దేశంలో ప్రజాస్వామ్య వ్యవస్థ బలహీనపడుతుంది.


అభ్యంతరకర అంశాలు ఆ సంస్థ దృష్టికి వచ్చినప్పటికీ కొనసాగించడంతోపాటు ఎలాంటి చర్య తీసుకోకపోవడం హాస్యాస్పదం, ఘోరం’అని పేర్కొన్నారు. ఈ వ్యవహారంపై సంయుక్త పార్లమెంటరీ కమిటీ(జేపీసీ) ఏర్పాటు చేయాలని కోరారు. ఇతర దేశాల్లో వదంతులు సృష్టించే, విద్వేషాలను పెంచే పోస్టులను తొలగించే ఫేస్‌బుక్‌.. భారత్‌లో మహిళలపై వేధింపులు, కొన్ని వర్గాలను, మతాలను లక్ష్యంగా చేసుకుని పెట్టే పోస్టులపై ఎలాంటి చర్యలు తీసుకోవడం లేదన్నారు. ఈ విధంగా ఒక్కో దేశానికి ఒక్కో  నిబంధనను ఫేస్‌బుక్‌ అమలు చేయడం సరికాదని తెలిపారు. ఫేస్‌బుక్‌తోపాటు వాట్సాప్‌లోనూ వదంతుల వ్యాప్తి, విద్వేషపూరిత సమాచారంపై  అదుపూ లేదన్నారు.

‘నా జీవితాన్ని నాశనం చేస్తామని, నన్ను చంపుతామంటూ ఆన్‌లైన్‌లో నా ఫొటో పెట్టి మరీ బెదిరిస్తున్నారు. వార్తా కథనాన్ని సాకుగా చూపుతూ నా ప్రతిష్టను దెబ్బతీసేలా, నా వ్యక్తిగత గౌరవానికి భంగం కలిగించేలా వ్యాఖ్యలు చేస్తున్నారు. ఆన్‌లైన్‌ ఈవ్‌టీజింగ్‌కు పాల్పడుతున్నారు. వీటి కారణంగా నాతోపాటు నా కుటుంబసభ్యుల భద్రత ప్రమాదంలో పడింది’అని ఆమె ఆ ఫిర్యాదులో పేర్కొన్నారు. ఈ మేరకు సంబంధిత సెక్షన్ల కింద కేసులు నమోదు చేసి, దర్యాప్తు బాధ్యతలను సైబర్‌ విభాగానికి అప్పగించినట్లు ఢిల్లీ పోలీస్‌ విభాగం అదనపు పీఆర్‌వో అనిల్‌ మిట్టల్‌ తెలిపారు.

పత్రికా స్వేచ్ఛ అనేది వ్యాపార స్వేచ్ఛలో భాగమైపోవడమే అత్యంత విస్మయకరం, విచా రకరం. పత్రిక అనేది ఒక వ్యాపారం కానప్పుడే అది స్వేచ్ఛగా ఉన్నట్టు లెక్క. అందుకే అది వ్యాపారానికి దూరంగా ఉండాలి. – కారల్‌ మార్క్స్‌  (లిటరేచర్‌ అండ్‌ ఆర్ట్స్‌) 



అనుమాన పిశాచమనే నీడలో హేతువు, రుజువు, కారణం నిలవవు, ఓడిపోతాయి. న్యాయం చచ్చిపోతుంది. అలాగే కొందరు జర్నలిస్టులు కూడా తాము ఏదో ఎదిగిపోవాలన్న తొందరలో అర్థసత్యాలతో ఏపగింపు కల్గిస్తూ అవే అంతిమ సత్యాలుగా పాఠకులపై రుద్దేస్తూ తమ స్వేచ్ఛను దుర్వినియోగపరచుకుంటారు. ఈ తెచ్చిపెట్టుకున్న దురద పనికిమాలిన చిల్లర మల్లర చెత్త పత్రికలకు వర్తిస్తుందే గానీ ఉత్తమ ప్రమాణాలతో నడిచే గొప్ప పత్రికలకు వర్తించదు. దేన్ని బడితే దాన్ని, ఎవరు ఏది చెబితే దాన్ని నమ్మేవారు మసాలా కబుర్లలో ఆనందం పొందే బాపతు మాత్రమే, ఏది నిజమో, ఏది కట్టుకథో తేల్చుకోలేని వారు మాత్రమే తాత్కాలిక ఆనందానికి లోనవుతారు. కానీ వ్యక్తుల వ్యక్తిత్వాలను నర్మగర్భంగా, ముసుగువేసి నాశనం చేయడానికి అత్యుక్తులు రాసి సెన్సేషనలిజం ద్వారా సర్క్యులేషన్‌ పెంచుకునే ధోరణి– ఉత్తమ ప్రమాణాలు గల పత్రికలకు పడదు. పచ్చి అబద్ధాలను ఎదుర్కో వడమూ ఆ క్రమంలో కష్టసాధ్యమే. అందుకే ఉత్తమ ప్రమాణాలు గల పత్రికల సంఖ్య తక్కువగా ఉంటుంది. ఇదే క్షమించదగిన జర్నలిజా నికి, క్షమార్హంకాని జర్నలిజానికి మధ్య ఉన్న తేడా. – జస్టిస్‌ వి.ఆర్‌. కృష్ణయ్యర్‌ (ఫ్రమ్‌ బెంచ్‌ టు ది బార్‌ పేజీ. 210)


ఆధునిక సాంకేతిక పరిజ్ఞానం (టెక్నాలజీ) మానవాళికి ఎన్ని రకాల అనంతమైన అవకాశాలను ప్రసాదించిందో అంతకన్నా మించిన అనర్థాలను కూడా బలవంతంగా రుద్దుతోంది. యాప్‌లు, వాట్సాప్‌లు, లింకులు, వెబ్‌ లింకులు, మొబైల్స్, సూట్‌ కేసులో ఇమిడిపోయే కూపీ (ట్రాకింగ్‌) వ్యవస్థలూ, ఫేస్‌ బుక్, ఇన్‌స్టాగ్రామ్‌లు (పాత టెలిగ్రామ్‌ భాషను అప్పటికప్పుడు ఆధునికంగా వండివార్చే, బాజా సాధనం) ఇలా సవాలక్ష ముమ్మరిస్తున్న దశలో ఉన్నాం. జుకర్‌ బర్గ్‌ రంగంలోకి వచ్చి ఫేస్‌ బుక్‌ అనే కూపీ వ్యవస్థను నర్మగర్భంగా రంగంలోకి  దించి దేశీయ సాంకేతిక, ఆర్థిక వ్యవస్థలను దేశాల ప్రయోజనాలకు విరు ద్ధంగా దేశీయ ప్రజలే ప్రయోగించేలా చేశాడు. ఆ మాటకొస్తే ఒకప్పుడు చైనీయులపైన నల్లమందు చల్లి, నల్లమందు భాయిలుగా బ్రిటిష్‌ వాడు ప్రచారం చేసినట్లే జుకర్‌బర్గ్‌ కూడా ఫేస్‌బుక్‌ ద్వారా భారతీయుల వ్యక్తిగత ఫోన్ల సమాచారాన్ని కోట్ల సంఖ్యలో ఫేస్‌ బుక్‌లో నమోదు చేసి అమెరికా, బ్రిటన్‌ మాళిగల్లో నిర్లిప్తంచేసి పెట్టాడు. అలా అని బీజేపీ పాలకులు జుకర్‌బర్గ్‌ ఫేస్‌బుక్‌ మనకే ఉపయోగిస్తుందని మురిసిపోయే సమయానికి మన పాలకుల గుట్టు మట్టుల్ని కూడా ఫేస్‌బుక్‌లో నిక్షిప్తం చేసేసరికి పాలకులు లబోదిబో మంటున్నారు. ఈ బాగోతం కాలిఫోర్నియాలో మన ప్రధాని హుషా రుగా జుకర్‌బర్గ్‌ను కలుసుకుని కరచాలనం చేసినంత సేపు పట్టలేదు.


ఇప్పుడు బీజేపీ వారు జుకర్‌బర్గ్‌ బీజేపీ రహస్యాలను ప్రైవేట్‌ వ్యాపార ప్రయోజనాల్లో భాగంగా ఫేస్‌బుక్‌ ద్వారా బట్టబయలు చేస్తున్న దశలో ఫేస్‌బుక్‌పై చర్యలు తీసుకోవాలని గగ్గోలు పెడు తున్నారు. మనం చైనాపై ‘గుర్రు’తో డజన్లకొద్దీ టిక్‌ టాక్‌లను, అప్పో లను నిషేధించినట్లు ప్రకటించుకున్నా అమెరికాతో మనకు పైన వేసు కున్న లింకుల వల్ల జుకర్‌బర్గ్‌ను వదిలించుకోలేము. అమెరికాలో జూకర్‌బర్గ్‌ బంధించి ఉంచిన మన ఫోన్‌ నంబర్లనూ విడుదల చేయించుకోలేని దుస్థితి ఈ సాంకేతిక ఉచ్చు మనచుట్టూ బిగియడానికి కారణం.. మన  సర్వర్ల ‘బిస’ అంతా అమెరికాలోనే ఉండటం! ఆంధ్ర ప్రదేశ్‌లో టెక్నాలజీ మాయ చాటున కొన్ని తొత్తు పత్రికలు కూడా ఇటు రాష్ట్ర ప్రభుత్వాన్నీ, అటు రాష్ట్ర న్యాయ వ్యవస్థనూ కూడా అబద్ధాల అల్లికతో అభాసుపాలు చేయడానికి సంకల్పించి తప్పుడు కథనాలకు తెరలేపుతున్నాయి. న్యాయవ్యవస్థకూ చట్టబద్ధంగా ప్రజలెన్నుకున్న రాష్ట్ర ప్రభుత్వానికీ మధ్య గండికొట్టి, అడుగువూడిన పాత పాలకులకు ప్రాణప్రతిష్ట చేయాలన్న తాపత్రయంకొద్దీ ‘న్యాయదేవతపై రాష్ట్ర ప్రభుత్వం నిఘా’ అంటూ అశరీరవాణి కథనాలు అల్లుతోంది: ఒక్క దానికీ రుజువులు లేవు.


పైగా రాష్ట్ర హైకోర్టు పేరును దుర్వినియోగపరుస్తూ, అలాంటి అలవాటులోనే ఉన్న ఆ ‘కెప్ట్‌ ప్రెస్‌’ అల్లిన కథనం అంతా ఆధునిక టెక్నాలజీ మెలకువలన్నింటినీ దుర్వినియోగం చేసి, ఆ కథనానికి తానే కర్త, కర్మ, క్రియగా మారిన మాస్టర్‌ అల్లిక అది. ఆ పత్రిక అల్లికల్లోని అంశాలు స్థూలంగా: ‘న్యాయమూర్తుల ఫోన్లు ట్యాప్‌? వెబ్‌లింక్‌ ద్వారా మొబైల్‌పై వల; వాట్సాప్‌ సందేశాలపైన నియంత్రణ, చదవక ముందే రీడింగ్‌మోడ్‌ లోకి, మాటల్లో అస్పష్టత, సమస్యలపై సాంకేతిక నిపుణులతో పరీక్ష, నెట్‌వర్క్‌ మొబైల్‌ మాత్రం బాగుందని నిర్ధారణ– అయినా అంతు చిక్కని ఇబ్బందులు అయినా నిఘాయే కారణమని అనుమానం, సూట్‌కేసులో ఇమిడిపోయే ట్రాకింగ్‌ వ్యవస్థ’ వల్ల ‘ఆధునిక టెక్నాలజీతో ఈ పనులన్నీ అత్యంత సులభమని’ ఆ కథనం సారాంశం. ఆ మొత్తం కథనం అంతా ఆధారపడింది వాస్తవాలపైన కాదు, పూర్తిగా ‘సొంత డబ్బా’పైననే! ‘న్యాయాన్ని అమ్మేవాడూ, దోవలు దోచేవాడూ ఒకటే’నన్న జగమెరిగిన మన తెలుగు సామెత. ఆ మాటకొస్తే అబద్ధం అంటేనే అతుకులమూట అనీ, అల్లిన కథనం దాచినా దాగని సత్యమనీ ప్రతి ఒక్కరికీ అర్థమవుతుంది. నిజానికి ‘న్యాయదేవతపై నిఘా’ వేసే తెలివితేటలు గాడితప్పి వ్యవహరిస్తున్న నడమంత్రపు పాత్రికేయులకు తప్ప వృత్తి ధర్మాన్ని, ప్రమాణాలను పాటించే వారికి ఉండజాలవు.


రాష్ట్ర రాజకీయ క్షేత్రంలో వైఎస్‌ జగన్‌ తనకు మించిన దీటైన పోటాపోటీతో తలపడి ‘ఢీ’కొనగల సత్తా ఉన్నవాడని భావించినందునే లోలోన టీడీపీ అధినేత చంద్రబాబు కుమిలిపోయాడు. అందుకే తప్పుడు ఆరోపణల పైన కుట్ర ద్వారా 16 మాసాలపాటు జైలుపాలు చేశాడని లోకానికి తెలిసి పోయింది. అయినా గత ఆరేళ్లకుపైగా సీబీఐ స్పెషల్‌ కోర్టులూ ఎంతసేపు ‘ఏవి మీ ఆధారాలు’ అని నిరంతరం ప్రశ్నిస్తూ ఉన్నా ఈ రోజుదాకా జగన్‌పై కేసులు అలా కొనసాగడం రాజ్య వ్యవస్థలో, న్యాయ వ్యవస్థల్లో చెండితనానికి నిదర్శనం కాదా? అంతేగాదు, చివరికి ‘ఆదాని శాసిస్తాడు/మోదీ పాటిస్తాడు/ జగన్‌ జైలుకు, భార్య భారతి ముఖ్యమంత్రి కుర్చీపైకి’ అనేంతగా పాత్రికేయ అజ్ఞాని బరి తెగించడాన్ని ఇతరులే కాదు, న్యాయ వ్యవస్థ కూడా సహించరానిది. దేశంలో న్యాయవ్యవస్థ పనితీరును గమని స్తున్న వారికి గత 70 ఏళ్లలో మన రాజ్యాంగ వ్యవస్థ, ప్రజాస్వామ్య వ్యవస్థ మనుగడకు ‘నాలుగు స్తంభాల’లో ఒకటైన పత్రికా వ్యవస్థతో పాటు మిగతా మూడు వ్యవస్థలు కూడా క్రమక్రమంగా ఎలా బీటలిచ్చి పోతు న్నాయో గమనించాల్సిన పరిణామం.


దీనికి కారణం– ఈ రాజ్యాంగ వ్యవస్థలేవీ రాజ్యాంగం నిర్దేశిం చిన మౌలిక లక్ష్యాలకు కట్టుబడకుండా గాడితప్పి నడుచుకొంటు న్నాయి. బహుశా అందుకనే సు్రçపసిద్ధ సుప్రీంకోర్టు మాజీ న్యాయ మూర్తి జస్టిస్‌ వీఆర్‌ కృష్ణయ్య కొన్ని విషయాలను ఇలా బాహాటంగా చెప్పగలిగారు: ‘న్యాయమూర్తులుగా పదవీ స్వీకారం చేసే ముందు రాజ్యాంగ నిబంధనలను కాపాడతానని ప్రతిజ్ఞ చేస్తారు. ఈ ప్రతిజ్ఞకు అర్థం– రాజ్యాంగం నిర్దేశించిన సోషలిస్టు, సెక్యులర్, ప్రజాస్వామ్య రాజకీయాలను పాటిస్తానని. ఇదెలా సాధ్యం? న్యాయమూర్తులకు రాజకీయ సిద్ధాంత తాత్వికత అనివార్యం. న్యాయమూర్తుల నియా మకం రాజ్యాంగం ప్రకారం జరిగిందిగానీ రాజ్యాంగానికి అతీతంగా జరగలేదు గనుక ఈ సైద్ధాంతిక నిబద్ధత అనివార్యం. ఒక కోటీశ్వ రుడు– మురికివాడల్లో నివసించే పేదవాడి ముందు నిలబడి నాకు రాజకీయాలు లేవు అని చెబితే అతణ్ణి మీరు నమ్ముతారా? అలాగే ఒక కార్మిక సంఘం నాయకుడు తన పారిశ్రామిక యజమాని ముందు నిల బడి నాకు రాజకీయాలు లేవంటే అది ఒట్టి తొండిమాట. రాజకీయా లున్నంత మాత్రాన వ్యక్తి న్యూనతగా భావించుకోరాదు. ‘నాకు రాజ కీయం’ లేదని దాచటం నేరం. మనం మనసిచ్చి భోళాగా మాట్లా డదాం. ఇతర వృత్తులలో ఉన్నవారి మాదిరిగానే న్యాయమూర్తులకు కూడా రాజకీయాలుంటాయి. కానీ, న్యాయ ప్రక్రియ అనేది మాత్రం కులాలకు, వర్గాలకు, సమూహాలకు అతీతం’! 


అంతేగాదు, కోర్టు ధిక్కార నేరాధికారాన్ని కోర్టు సమర్థించు కోవాలంటే, జరగాల్సిన న్యాయాన్ని జరగనివ్వకుండా అడ్డుకునే ప్రయత్నంలో కోర్టు తన ‘ధిక్కార ప్రయోగా’న్ని సమర్థించడం సబబ వుతుందని జస్టిస్‌ బ్లాక్‌ (1943) నిర్ధారించాడు. అలాగే కోర్టు తీర్పును సదుద్దేశంతో విమర్శించే ఎవరినీ తప్పుబట్టరాదనీ, అలాంటి విమర్శ సామాన్యుడి హక్కు అనీ ప్రివీకౌన్సిల్‌లో ఏనాడో లార్డ్‌ అడ్కిన్‌ ప్రకటిం చాడు. అంతేగాదు, నిజం చెప్పాలంటే, వార్తా పత్రికల్లో వచ్చే విమ ర్శలవల్ల వృత్తి నైపుణ్యంగల ఏ న్యాయమూర్తీ ప్రభావితుడు కాడని క్వీన్స్‌ కౌన్సిల్‌ సీనియర్‌ సభ్యుడు, సుప్రసిద్ధ న్యాయమూర్తి లార్డ్‌ డెన్నింగ్‌ స్పష్టం చేశాడు. మీడియాలో వచ్చే విమర్శలకు ఏ న్యాయ మూర్తీ ప్రభావితం కాకనక్కర్లేదనీ, వాటిని వృత్తిరీత్యా వచ్చే ఇబ్బందు లుగానే భావించి న్యాయమూర్తులు కూడా ప్రజల విమర్శను శిరసా వహించడం ధర్మమని లార్డ్‌ సాల్మన్‌ ప్రకటించాడు. అన్నింటికన్నా ‘కోర్టు ధిక్కార నేరం’ అనే ఆరోపణల గురించి లార్డ్‌ డెన్నింగ్‌ ఒక శిలా శాసనంగానే లభించిన పరిపక్వమైన వాక్యాలను ప్రపంచ న్యాయ శాస్త్రవేత్తలు తరచుగా పేర్కొనడాన్ని మనం మరచిపోరాదు. 


‘ఈ కోర్టు ధిక్కారమనే మన అధికారాన్ని మన న్యాయమూర్తుల సొంత గౌరవాన్ని ప్రదర్శించుకోవడానికి ఉపయోగించరాదు. స్పష్ట మైన సాక్ష్యంమీదనే ధిక్కార నేరం మోపాలి. అంతేగానీ మనను విమ ర్శించే వారిని అణచడం కోసం ఈ అధికారాన్ని వినియోగించరాదు. మనం విమర్శకు భయపడరాదు, విమర్శను వ్యతిరేకించరాదు. కానీ అంతకన్నా మనం కోల్పోయే అత్యంత ముఖ్యమైన ప్రాణప్రదమైన స్వేచ్ఛ ఒకటుంది– అదే భావప్రకటనా స్వేచ్ఛ. ప్రజాప్రయోజనాలకు సంబంధించిన విషయాలపైన సరసమైన వ్యాఖ్య, భోళా విమర్శ చేసే హక్కు పార్లమెంటులోనూ, బయటా, పత్రికల్లోనూ, టీవీలలోనూ పౌరులకు ఉంది. మా ప్రవర్తనే అంతిమ సాక్ష్యంగా నిలబడాలి. అంతే గానీ, చుట్టూ చెడు జరుగుతుంటే మౌనంగా ఉండిపోవటం మార్గం కాదు’ అలా అని, పత్రికలు తమ సర్క్యులేషన్‌ పెంచుకోవడానికి అవధులు లేని స్వేచ్ఛతో ఇతరులపై తప్పుడు ఆరోపణలు, నిందలు వేయటానికి పూనుకోవటం భావ స్వేచ్ఛను దుర్వినియోగం చేయడమే నని డెన్నింగ్‌ ప్రకటించాడు. అందుకేనేమో క్యూబా విప్లవ నేత ఫిడెల్‌ క్యాస్ట్రో అత్యంత స్పష్టంగా హెచ్చరించిపోయాడు– ‘నా ఒక్కడివల్లే, దేశం మారిపోతుందా? అనుకునే ఏ ఒక్కడివల్లా దేశానికి ప్రయోజనం లేదు’ అని!!

న్యూఢిల్లీ: న్యాయవాది ప్రశాంత్‌ భూషణ్‌కి సుప్రీం కోర్టులో గట్టి ఎదురుదెబ్బ తగిలింది. సుప్రీంకోర్టు, ప్రధాన న్యాయమూర్తి జస్టిస్‌ ఎస్‌ఏ బాబ్డే ప్రతిష్టకు భంగం కలిగేలా ట్వీట్లు చేసినందుకు అత్యున్నత న్యాయస్థానం ఆయనను దోషిగా తేలుస్తూ శుక్రవారం తీర్పు చెప్పింది. న్యాయవ్యవస్థపైనే ప్రశాంత్‌ భూషణ్‌ వదంతులు వ్యాప్తి చేయడానికి ప్రయత్నించారని అవన్నీ దేశ గౌరవాన్నే దెబ్బ తీసేలా ఉన్నాయని జస్టిస్‌ అరుణ్‌ మిశ్రా, జస్టిస్‌ బీఆర్‌ గవాయ్, జస్టిస్‌ కృష్ణమురారిలతో కూడిన బెంచ్‌ వ్యాఖ్యానించింది. ఈ నెల 20న శిక్ష ఖరారు చేయనుంది. కోర్టు ధిక్కార కేసులో ఆయనకు 6నెలల జైలు శిక్ష, రూ.2 వేల జరిమానా విధించే అవకాశాలున్నాయి. ఈ కేసు నుంచి ట్విట్టర్‌కి విముక్తి కల్పించింది.  

 ‘నిర్భయంగా, నిష్పక్షపాతంగా తీర్పులు చెప్పే న్యాయస్థానాలు ఆరోగ్యకరమైన ప్రజాస్వామ్యానికి పెట్టని గోడలు’ అని   ధర్మాసనం అభివర్ణించింది. రాజ్యాంగానికి మూలస్తంభమైన అత్యున్నత న్యాయస్థానంపై ప్రశాంత్‌ భూషణ్‌ దాడికి దిగారని, అది కోర్టు ధిక్కారమేనని స్పష్టం చేసింది.

 ప్రశాంత్‌ భూషణ్‌ జూన్‌ 27న చేసిన ట్వీట్‌లో దేశంలో అధికారికంగా ఎమర్జెన్సీ విధించకపోయినా ప్రజాస్వామ్యం ఖూనీ అవుతోందని, గత ఆరేళ్లలో సుప్రీం కోర్టు పోషించిన పాత్ర, నలుగురు ప్రధాన న్యాయమూర్తులే దీనికి కారణమన్నారు. రెండో ట్వీట్‌లో ప్రధాన న్యాయమూర్తి బాబ్డే ఎలాంటి మాస్క్, హెల్మెట్‌ ధరించకుండా నాగపూర్‌లోని రాజ్‌భవన్‌లో బీజేపీ నేతకు చెందిన రూ.50 లక్షల బైక్‌ని నడుపుతున్నారని, లాక్‌డౌన్‌ అంటూ జనం సమస్యల్ని ప్రత్యక్షంగా విచారించడానికి నిరాకరిస్తూ హెల్మెట్‌ లేకుండా ప్రధాన న్యాయమూర్తి ఎలా బండి నడుపుతారంటూ ఆ ట్వీట్‌లో ప్రశ్నించారు.

Hyderabad: AIMIM president Asaduddin Owaisi termed the Supreme Court verdict a “victory of beliefs over facts” and said he will ask the All India Muslim Personal Board (AIMPLB) to seek a review. “The Supreme Court was supreme but not infallible,” he said.

Expressing his dissatisfaction, Mr Owaisi said that the BJP is preparing the roadmap to a Hindu Rashtra through Ayodhya.


The MIM leader said he did not know whether the AIMPLB would proceed for a review petition or not, and whether it would accept land for the mosque or not, but his personal opinion was that the five acres for the mosque should be rejected.

Mr Owaisi told the media that the country is proceeding towards Hindu Rash-tra. Starting from Ayodh-ya, the Sangh Parivar and the BJP will exploit the National Register of Citizens (NRC) and the Citizen Amendment Bill.

He said that even those who politically disagreed with him ought to mark his words which would prove true in the future.

“If Babri Masjid had not been demolished in 1992, then what kind of verdict would the Supreme Court have delivered?” Mr Owaisi wondered.

“Muslims of India have faith in the Constitution of India,” he said. “We were contesting the case for our legal right. Though Muslims are poor and weak and discriminated against, they are not so miserable that they could not buy five acres of land for the Masjid. If I ask the people of Hyderabad, they will donate so much that I can build a mosque in Uttar Pradesh. We don’t need alms from anyone. We don’t need patronage from any corner.”

Nearly an hour before his post, the Lok Sabha lawmaker retweeted the All India Muslim Personal Law Board’s (AI tweet, which quoted its general secretary reaction to the judgement.

“The judgment is against our expectations. We presented solid evidences to prove our stance. Our legal committee will review the judgment. We have sincerely tried to fulfill our responsibility to restore the demolished,” the tweet read.

Addressing a press conference shortly after his cryptic tweet, Owaisi made it clear that he was not happy about the judgment. He called for offer of land to be rejected and said he would stand with any recourse the AIMPLB chooses to take.

Underlining that the Muslim parties were fighting for “rights” not just five acres of land, Owaisi said, “We were fighting for our legal rights. We can make a mosque. We don’t need to beg. You don’t need to patronise us.”

Owaisi, who has emerged as the main political voice of the Muslim community, said, “Faith has prevailed over facts” with regards to the Supreme Court’s verdict today. 

Owaisi kept repeating the Supreme Court was “supreme but not infallible,” attributing the quote to  Justice J.S. Verma, a former Chief Justice of India.

The disputed site in Ayodhya was awarded to the Hindu parties, while the top court directed the Centre to allot a 5-acre plot to the Uttar Pradesh Sunni Central Waqf Board for building a mosque.


“The Ayodhya verdict holds no value for us. We are dissatisfied with the verdict. It has a lot of contradictions. We will seek a review,” the Sunni Waqf board’s lawyer Zafaryab Jilani said after the judgement.

Supreme Court judge Justice Deepak Gupta said on Saturday that Indian citizens have the right to criticise the government, and such criticism cannot be construed as sedition, The Indian Express reported. He was addressing a lawyers’ workshop organised by a charitable trust in Ahmedabad.

Gupta clarified at the beginning of his speech, titled “Sedition and Freedom of Expression”, that his views were personal and not in his official capacity as a judge of the Supreme Court. “Criticism of the executive, the judiciary, the bureaucracy, the armed forces cannot be termed sedition,” Gupta said. “If we stifle criticism of these institutions, we shall become a police state instead of a democracy.”

“For me, there is a very important right which is not spelt out in the Constitution… the right of freedom of opinion, the right of freedom of conscience, by themselves, include the most important right: the right to dissent,” Gupta said. He added that a society which sticks to traditional rules degenerates.

“New thinkers are born when they disagree with well-accepted norms of the society,” Justice Gupta added. “If everybody follows the well-trodden path, no new paths will be created and no new vistas of the mind will be found.”

The judge asked the audience to always question “why”. “Only then the society will develop,” he said.

Gupta said that in a secular country like India, the atheist, agnostic and believers all have a right to freedom of expression. The judge reminded the audience of the dissent expressed by judge HR Khanna in a case related to those detained during the Emergency in 1975. Khanna was the only judge in the five-judge bench who ruled against unrestricted powers of detention.

“We have the right to criticise the government in power, whichever government it may be,” the judge said. “The misuse of the sedition law is against the very principle that our freedom fighters fought for.” Gupta added that even the judiciary is not above criticism, and must introspect its own actions.

There have been a number of sedition cases slapped against individuals expressing anti-establishment views over the past few years. On Friday, former Jawaharlal Nehru University student leader Shehla Rashid was charged with sedition for tweeting allegedly fake news about the Indian Army.

Student activists Kanhaiya Kumar, Anirban Bhattacharya and Umar Khalid have also been charged with sedition for their involvement in a protest in 2016 in which several students allegedly shouted “anti-national” slogans. The protest, which was against the hanging of Parliament attack convict Afzal Guru, had led to outrage by Hindutva groups.

Criticism of the executive, judiciary, bureaucracy or the armed forces cannot be termed sedition, Supreme Court judge Justice Deepak Gupta has said in a valedictory address that should rank among the most important speeches delivered in the country in recent memory.

“In case we attempt to stifle criticism of the institutions whether it be the legislature, the executive or the judiciary or other bodies of the State, we shall become a police State instead of a democracy and this the founding fathers never expected this country to be,” Justice Gupta said in the address on “Law of sedition in India and freedom of expression” at a workshop of lawyers in Ahmedabad.

The address, organised by the Praleen Public Charitable Trust and Lecture Committee, was delivered on Saturday.

Justice Gupta said that in today’s world, if someone were to echo what Rabindranath Tagore had said about nationalism (“a great menace”), the person “may well be charged with sedition”.

The following are excerpts from Justice Gupta’s 33-page address. The sub-headings were added by this newspaper.

Freedom of speech

There cannot be any democratic polity where the citizens do not have the right to think as they like, express their thoughts, have their own beliefs and faith, and worship in a manner they feel like.

The right of freedom of opinion and the right of freedom of conscience by themselves include the extremely important right to disagree.

New paths

Every society has its own rules and over a period of time when people only stick to the age-old rules and conventions, society degenerates. New thinkers are born when they disagree with the accepted norms of society. If everybody follows the well-trodden path, no new paths will be created, no new explorations will be done and no new vistas will be found.

Higher issues

We are not dealing with vistas and explorations in the material field; we are dealing with higher issues. If a person does not ask questions and does not raise issues questioning age-old systems, no new systems would develop and the horizons of the mind will not expand.

Whether it be the Buddha, Mahavira, Jesus Christ, Prophet Muhammad, Guru Nanak Dev, Martin Luther, Kabir, Raja Ram Mohan Roy, Swami Dayanand Saraswati, Karl Marx or Mahatma Gandhi, new thoughts and religious practices would not have been established if they had quietly submitted to the views of their forefathers and not questioned the existing religious practices, beliefs and rituals.

Dissent

The right to dissent is one of the most important rights guaranteed by our Constitution. As long as a person does not break the law or encourage strife, he has a right to differ from every other citizen and those in power and propagate what he believes is his belief.

No fear

A very important aspect of a democracy is that the citizens should have no fear of the government. They should not be scared of expressing views that may not be liked by those in power.

No doubt, the views must be expressed in a civilised manner without inciting violence, but mere expression of such views cannot be a crime and should not be held against the citizens.

The world would be a much better place to live in if people could express their opinions fearlessly, without being scared of prosecutions or trolling on social media.

It is indeed sad that one of our celebrities had to withdraw from social media because he and his family members were trolled or threatened with dire consequences.

Sedition law

The foremost thing that one must keep in mind is that this (sedition) law was introduced at a time when we were ruled by a foreign imperialist, colonising power. The British brooked no opposition and did not want to listen to any criticism. Their sole aim was to deprive the people of this country of their rights, including the right to express their views.

The Mahatma

I would also like to refer to the Father of the Nation, Mahatma Gandhi, who in this city of Ahmedabad was charged with sedition.

While appearing before sessions judge Broomfield, Mahatma Gandhi, while dealing with the word “disaffection”, had this to say: “Affection cannot be manufactured or regulated by law. If one has no affection for a person or system, one should be free to give the fullest expression to his disaffection, so long as he does not contemplate, promote or incite to violence.”

I think this brilliantly sums up what I want to say today — that mere criticism without incitement to violence would not amount to sedition. However, the Mahatma was sentenced to undergo imprisonment for six years.

You cannot force people to have affection for the government.

(Justice Gupta quoted Justice Nariman’s opinion in a case to cite three concepts that are fundamental to understanding the freedom of speech and expression. The first is discussion, the second advocacy and the third incitement. Justice Gupta quoted Justice Nariman: “Mere discussion or even advocacy of a particular cause howsoever unpopular is at the heart of Article 19(1)(a). It is only when such discussion or advocacy reaches the level of incitement that Article 19(2) kicks in. It is at this stage that a law may be made curtailing the speech or expression….” Article 19(1)(a) deals with freedom expression. Article 19(2) allows reasonable restrictions.)

This passage brilliantly sums up what should be applied even (to) the laws of sedition…. (But) the harsh reality is that the art of conversation is itself dying. There is no healthy discussion; there is no advocacy on principles and issues. There are only shouting and slanging matches. Unfortunately, the common refrain is, either you agree with me or you are my enemy, or worse, an enemy of the nation, an anti-nationalist.

The constitutional validity of Section 124A (the sedition law) has to be read in the context of Article 19 of the Constitution of India. Thus, it is clear that advocating any new cause, however unpopular or uncomfortable it may be to the powers that be, must be permitted.

Huge majority

Majoritarianism cannot be the law. Even the minority has the right to express its views. We must also remember that in India we follow the first-past-the-post principle. Even governments which come in with a huge majority do not get 50 per cent of the votes. Therefore, though they are entitled to govern or be called (the) majority, it cannot be said that they represent the voice of all the people.

Sedition can arise only against a government established by law. The government is an institution, a body and not a person. Criticism of persons cannot be equated with criticism of the government. During the dark days of the Emergency, an attempt was made by one party president to equate his leader with the country. That attempt miserably failed and, I’m sure, no one will ever try in future to equate a personality with this country of ours, which is much bigger than any individual.

Criticism of senior functionaries may amount to defamation, for which they can take action in accordance with the law but this will definitely not amount to sedition or creating disharmony.

Strong shoulders

I think our country, our Constitution and our national emblems are strong enough to stand on their own shoulders without the aid of the law of sedition. Respect, affection and love is earned and can never be commanded. You may force or compel a person to stand while the national anthem is being sung but you cannot compel him within his heart to have respect for (it). How does one judge what is inside a person’s mind or in his heart?

In Manipur, a journalist made a vituperative attack on the chief minister of the state and used totally unparliamentary language against the Prime Minister of the country. The language was intemperate and uncalled for but this was not a case of sedition. It was at best a case of criminal defamation. The man was kept behind bars for months under the National Security Act.

In West Bengal, a party leader was arrested for morphing an image of the chief minister and in UP, a man was arrested for morphing the image of the Prime Minister and shockingly this image had been morphed five years back. What was the hurry to suddenly arrest this man after five years?

Tone down

In my view, the law of sedition needs to be toned down if not abolished and the least which the government can do is make it a non-cognisable offence so that persons are not arrested at the drop of a hat.

Right to criticise

India is a powerful nation, loved by its citizens. We are proud to be Indians. We, however, have the right to criticise the government. Criticism of the government by itself cannot amount to sedition. The shoulders of those in power who govern should be broad enough to accept criticism. Their thinking should be wide enough to accept that there can be another point of view. Criticism of the policies of the government is not sedition unless there is a call for public disorder or incitement to violence.

The people in power must develop thick skins. They cannot be oversensitive to people who make fun of them. If intemperate, uncivilised and defamatory language is used, then the remedy is to file proceedings for defamation but not prosecute the persons for sedition or creating disharmony.

Judiciary

We all must be open to criticism. The judiciary is not above criticism. If judges of the superior courts were to take note of all the contemptuous communications received by them, there would be no work other than the contempt proceedings. In fact, I welcome criticism of the judiciary because only if there is criticism will there be improvement. Not only should there be criticism but there must be introspection. When we introspect, we will find that many decisions taken by us need to be corrected.

Police state

Tagore

Gurudev Rabindranath Tagore had a view on nationalism which is the antithesis of the view which many of us have. He, in fact, had not appreciated the Satyagrah movement. He who wrote the national anthem also held the view that “nationalism is a great menace”. I do not agree with those views nor did eminent leaders of that time but this did not make Gurudev Rabindranath Tagore (any) less an Indian, less a patriot than any of his contemporaries.

Merely because a person does not agree with the government in power or is virulently critical of the government in power does not make him any less a patriot than those in power. In today’s world, if any person was to say “nationalism is a great menace” he may well be charged with sedition.

New Delhi: Delivering a speech on ‘Law of Sedition in India and Freedom of Expression’ at a lawyers’ workshop on September 7, Supreme Court judge, Justice Deepak Gupta criticised the rising misuse of the sedition law in the country. The workshop was organised by the Praleen Public Charitable Trust in Ahmedabad, Gujarat.

Justice Gupta began his speech by talking about the right to freedom of expression which is enshrined in the Indian Constitution as a fundamental right under Article 19(1)(a), and its importance in the interpretation of legal provisions including the law of sedition.

He said, “This right is a well-recognised right which includes within its ambit the right of freedom of press, the right to know, right to privacy, etc. Article 21 prescribes that no person shall be deprived of his life or personal liberty except according to the procedure prescribed by law. The word life has been given an expansive meaning and has been now recognised to mean to live a life of decency and not a mere animal existence.”

He also said that the Constitution not just guarantees the right to freedom of expression but, also recognises the right to dissent. Highlighting the importance of this right, especially in a secular and democratic country like India, he said, “As long as a person does not break the law or encourage strife, he has a right to differ from every other citizen and those in power and propagate what he believes is his belief. The judgment of H. R. Khanna, J. in the A.D.M. Jabalpur case, is a shining example of a dissent which is much more valuable than the opinion of the majority.”

Another important aspect of a democracy, he said, is that “the citizens should have no fear of the government. They should not be scared of expressing views which may not be liked by those in power. No doubt, the views must be expressed in a civilised manner without inciting violence but mere expression of such views cannot be a crime and should not be held against the citizens.”

In this context, he talked about the law of sedition, which is actually a colonial law. He said that the law was introduced to repress the freedom struggle waged by the people of this country against the British imperial rule. Citing an example of how this law was used by the British government, Gupta said, “At this stage, I would also like to refer to the Father of the nation Mahatma Gandhi, who in this city of Ahmedabad was charged with sedition. Appearing before Sessions Judge Broomfield, Mahatma Gandhi while dealing with the word ‘disaffection’ had this to say, “Affection cannot be manufactured or regulated by law. If one has no affection for a person or system, one should be free to give the fullest expression to his disaffection, so long as he does not contemplate, promote or incite to violence.”

This, he said, sums up that mere criticism without incitement to violence would not amount to sedition. Slamming the current government’s method of dealing with dissent, he said that nowadays, the law of sedition is more often abused and misused. The people who criticise those in power are arrested by police officials on the asking of those in power and even if a person may get bail the next day from the court, he has suffered the ignominy of being sent to jail.

Citing an example of the misuse of sedition law, he said, “In 2011, the Mumbai police arrested Asim Trivedi, a cartoonist for circulating a cartoon which allegedly poked fun at the Constitution and the National Emblem in an anti- corruption rally organised by Anna Hazare. This led to the Bombay High Court issuing directions to the police that before arresting a person on charges of sedition the senior officials should be consulted. “

Talking about the increasingly common trend of tagging someone as an anti-national, he said, “There is no healthy discussion; there is no advocacy on principles and issues. There are only shouting and slanging matches. Unfortunately, the common refrain is either you agree with me or you are my enemy, or worse, an enemy of the nation, an anti-nationalist.”

He added, “Criticism of the executive, the judiciary, the bureaucracy or the Armed Forces cannot be termed sedition. In case we attempt to stifle criticism of the institutions whether it be the legislature, the executive or the judiciary or other bodies of the State, we shall become a police State instead of a democracy and this the founding fathers never expected this country to be.”

Justice Gupta stressed that “the law laid down in Kedar Nath Singh vs State of Bihar, being the law of the land has to be applied in letter and spirit and unless the actions lead to creation of public disorder, disturbance of law and order or incitement to violence, no action should be taken. In fact, in my view, the law of sedition needs to be toned down if not abolished and the least which the Government can do is to make it a non-cognisable offence so that the persons are not arrested at the drop of a hat.”

Highlighting the necessity of the government to respect the rights of its citizens as enshrined in the Constitution, he concluded his speech by saying, “To progress in the field of human rights and be a shining example of an effective, vibrant democracy then the voice of the people can never be stifled.”

A special National Investigation Agency (NIA) court in Mumbai on Monday rejected an exemption application filed by newly-elected Bhopal MP Sadhvi Pragya Singh Thakur.

Sadhvi Pragya, through her lawyers, was seeking an exemption to appear before the court in the ongoing trial between June 3 and 7.

Sadhvi Pragya Singh Thakur is one of the accused in the Malegaon blast case, which left six people dead and more than 100 injured on September 29, 2008.

Advocate J P Thakur filed the application on behalf of Pragya Singh Thakur seeking exemption for the entire week.

The BJP MP had pointed out that she had to complete some of Parliament-related procedures such as getting enrolled and collecting her identity card etc.

However, the court cited a Supreme Court ruling and directed the blast accused to be present for the hearing this week.

Earlier on May 17 the special court had ordered Sadhvi Pragya Singh Thakur and other accused to be present at least once.

The court was on vacation after that and resumed the proceedings only now.

While the three other accused in the blasts case -- Sameer Kulkarni, Ajay Rahirkar and Lt Col Prasad Purohit -- were present in the court to mark their attendance during the trial today.

But Pragya Singh Thakur and another accused Sudhakar Chaturvedi and others did not appear before the court.

These directions to attend court is given so that the accused are aware of the evidence submitted in the court and also so that the accused themselves can put forth their say.

Judge VS Padalkar presiding over the court proceedings further said, "Now the accused no.1 (Thakur) being a Member of Parliament has stated in her application that she is a political leader, which is why the matter has been expedited. In case of failure to obey this direction, necessary legal order will be passed."

So far in the Malegaon 2008 trial, over 115 witnesses have deposed in the court.

Sadhvi Pragya Thakur's legal team had admitted these witnesses and did not challenge them.

However, the court said, material witnesses are being called by the prosecution to cite their evidence to prove their case against the accused persons. Hence, the presence of accused persons is certainly necessary".

Pragya Singh Thakur is likely to come to Mumbai for hearing on June 6 or 7.

Arrested in 2008, Bhopal MP was given a clean chit by the NIA, but the trial court refused to discharge her from the case.

Pragya Singh Thakur and others are being tried under the Unlawful Activities Prevention Act. She was granted bail by the Bombay High Court in 2017.

"A mixture of gau mutr (cow urine) and other cow products cured my cancer," said BJP candidate from Bhopal Lok Sabha constituency Sadhvi Pragya. She was speaking to India Today TV as she filed her nomination from the seat in Madhya Pradesh.

When asked about the current politics around cows in India, she said it was painful to see how cows are treated in many places. "Godhan amrit hai (owning cattle is like consuming divine nectar)," she told India Today TV.

Sadhvi Pragya also enumerated the various health benefits of the cow and cow products. The biggest health benefit according to her is that consuming cow urine helped her cure her cancer. The BJP candidate from Bhopal, who is also an accused in the 2008 Malegaon blasts case, is a breast cancer survivor. "I was a patient of cancer and I cured myself by consuming gau mutr (cow urine) and panchgavya mixed ayurvedic herbs," she said.

Panchagavya is a mixture used in traditional Hindu rituals that is prepared by mixing five cow products. The three direct constituents of the mixture are cow dung, urine, and milk; the two derived products are curd and ghee. These are mixed in proper ratio and then allowed to ferment.

Sadhvi Pragya called the cure scientific, saying, "I am a living example of its effectiveness."

She also claimed that rubbing a cow in a certain way can help one control their blood pressure. "If you rub gau mata from the back towards the neck she will be pleased. If you do it every day, your BP will stay in control," she said as she fed cows in a cattle shelter.

Explaining the cure in detail, Sadhvi Pragya said, "If you rub the cow from back to the neck, you will experience joy and the cow will also experience joy but if you rub her from neck to back the animal will feel uneasy. If you rub from back to front, your BP will be maintained. This is Amrit (divine nectar). This is scientific. A gaushala (cow shelter) is the best place for Tapasya (penance)."

Sadhvi Pragya filed her nomination papers for the Lok Sabha election from Bhopal on Monday amid chanting of mantras. The BJP candidate, an accused in the 2008 Malegaon blast case, currently out on bail, filed her nomination based on what she claimed was an "auspicious time" after arriving at the collectorate here with 11 priests who chanted mantras.

The 48-year-old right-wing activist said she would file her papers "formally" on Tuesday.

She said she chose the time to file her nomination on Monday based on "choghadiya", a Hindu Vedic calendar.

Sadhvi Pragya, making her electoral debut, is pitted against senior Congress leader and former chief minister Digvijay Singh. Bhopal, a BJP bastion since 1989, will vote on May 12.

Undeterred by the Election Commission's notice for her controversial remarks on slain IPS officer Hemant Karkare, BJP candidate Sadhvi Pragya Singh Thakur continues her tirade against the 26/11 hero.

In the middle of her campaign in Bhopal, she accused the Ashoka Chakra recipient of torturing her in custody.

"That phase, that pain is unimaginable. The kind of pain I underwent cannot be described," she told India Today TV. "You cannot imagine how a saffron-clad sanyasi who had dedicated her life to the nation was subjected to abuse. My sanyasi appearance was reviled," Sadhvi Pragya alleged, referring to her police interrogation in connection with her suspected role in the 2008 Malegaon blast.

She named Hemant Karkare when probed who tormented her during questioning.

"Hemant Karkare. That was when I was held in illegal confinement... I cannot express in words the torture, the filthy expletives I suffered while I was in police custody for eleven days," she charged.

On Saturday, election authorities sought an explanation from the BJP's Bhopal candidate Sadhvi Pragya for her accusations against Hemant Karkare, who was killed in action during the 2008 Mumbai terror attacks.

"Hemant Karkare falsely implicated me (in Malegaon blasts) and treated me very badly. I told him your entire dynasty will be erased. He died of his karma," she told party workers last week, sparking widespread criticism.

In her interview to India Today TV, the Sadhvi alleged she was beaten up in Karkare's custody.

"I was asked no question but was beaten up instead," she alleged.

HITTING RIVALS OVER HINDUTVA PLANK

The Sadhvi reiterated her accusations that she was a victim of "conspiracy". "The UPA government hatched a conspiracy and got me arrested in 2008. They tried to frame me in what they called saffron or Hindu terror."

Sadhvi Thakur sought to portray her election bid as an attempt to prove that saffron terror, as alleged by her opponents, does not exist in Indian tradition.

"I am not here to polarise. This election will, in fact, establish that there's nothing like saffron or Hindu terror," she insisted.

The Sadhvi described her rival from Bhopal, Digvijaya Singh, as the real "author" of her alleged distress, charges the Congress leader rebutted.

"The man who authored my torture is standing as a candidate from here. He's the man behind the mentality that unleashed gross injustice on people like us, imprisoned the nation-loving Hindus and the saffron-clad sanyasis like me," she alleged.

On his part, Digvijay Singh denied her accusations.

"I don't know why she says like this. No case was registered against her during my government," the Congress leader told India Today TV in a separate interview. He insisted that the Sadhvi had been arrested by the Madhya Pradesh police earlier under the Shivraj Singh Chouhan government.

"She should be unhappy with Shivraj Singh. He arrested her twice and put her behind the bars," Singh remarked.

But the Sadhvi sounded unforgiving. She attacked the Congress candidate over the Hindutva plank.

"If he (Singh) was a Hindu, he couldn't have denigrated saffron or the Hindus as terrorists. He had referred to Hindu terrorism," she claimed.
